Shahbandr provides a range of tools and resources for managing online stores, processing orders, and selling products online, as well as offering professional services related to these activities or other associated services. All of the above are referred to as “services.”
Below are the terms, conditions, and provisions for using these services, along with any amendments and any operational rules or policies that may be published from time to time by Shahbandr.
**First: Services and Support**
1. Services are provided according to these terms and any operational policies established by Shahbandr, collectively referred to as the “Agreement.” Shahbandr may make changes to this Agreement and these terms, and continued use of any services constitutes the client’s acceptance of these changes. When using specific services, the client and Shahbandr are subject to any guidelines or rules published from time to time.
2. Services are only available to individuals legally capable of entering binding contracts. Services are not available to those under 18 years old. If ineligible, please do not use the services.
3. The services include tools and resources for managing an online store, processing orders, and selling products online. The company may also provide consulting services related to the use of these tools.
4. The client must complete the registration form to fully enjoy the company’s services, providing accurate and current information, and update it as necessary. As part of the registration process, the client will select an email and password for their Shahbandr account. The client is responsible for securing their account and all uses under their name. Shahbandr reserves the right to refuse or cancel accounts deemed inappropriate.
**Second: Restrictions and Responsibilities**
1. This is a services agreement, and no license for any software is granted to the client. The client agrees not to:
– Reverse engineer or decrypt the company’s software.
– Attempt to discover source code, object code, or underlying ideas or algorithms.
– Modify, translate, create derivative works, or transfer rights to services or software.
– Use services for third-party benefit without written permission.
– Remove proprietary notices.
2. The client must use services per Shahbandr’s Privacy Policy and applicable laws, without engaging in spam or unauthorized email practices. The client agrees to indemnify Shahbandr against claims arising from violations.
3. For every email sent, the client ensures the recipient’s consent and agrees not to send unsolicited emails.
4. When using services, the client may provide personal information, which Shahbandr uses to tailor offerings or communicate. Shahbandr will not share or sell this information without the client’s consent.
**Third: Termination**
1. The client may terminate this agreement at any time by sending an email to support@shahbandr.com.
2. Shahbandr may terminate this agreement or services at any time if any policies are violated, with or without notice. The company bears no responsibility to the client or any third party for such termination.
3. Shahbandr may terminate the agreement if the client uses the service to sell or promote illegal products or services.
4. Shahbandr may terminate the agreement if the client uses the service for pornography, inappropriate materials, or incitement of violence.
5. Upon termination, Shahbandr may delete archived client data within 90 days. The client can import/export their data anytime using Shahbandr’s tools.
**Fourth: Payment and Service Renewal**
1. **Service Term:** The client’s service subscription begins upon acceptance of these terms and ends as previously specified.
2. **Payment:** The client agrees to pay all applicable fees for services at the time of registration, initial use, or renewal, subject to these terms and any amendments made by Shahbandr.
3. **Automatic Account Renewal:** Shahbandr will attempt to renew the client’s hosting account 14 days before expiration, charging the current non-promotional rate to the client’s specified payment method.
4. **Canceling Automatic Renewal:** To cancel, the client must notify Shahbandr at least 16 days before the expiration date via email to admin@shahbandr.com.
5. **Cancellation and Refunds:** Shahbandr does not offer a money-back guarantee for new account registrations under any circumstances.
6. **Prohibited Offers:** Clients cannot use services to provide, sell, or promote illegal items such as counterfeit goods, controlled substances, alcohol, tobacco, drugs, weapons, pirated content, or adult-related materials.
7. **Profanity:** Profane or offensive content, including in domain names, is strictly prohibited.
8. **Private Information and Images:** Clients must not disclose personal information or images of minors or third parties without consent.
9. **Intellectual Property Violations:** Any violation of intellectual property rights or privacy is forbidden. Shahbandr is required by law to remove or block access to infringing content.
10. **Misrepresentation:** Forging or misrepresenting message headers or IP addresses to conceal the origin of a message is prohibited.
11. **Viruses and Other Destructive Activities:** The use of services to create or send viruses, worms, or engage in denial-of-service attacks is prohibited. Disruptive activities that interfere with others’ use of the services are also banned.
12. **Hacking:** Unauthorized access to computers, networks, or security measures, including port scanning and intrusion attempts, is strictly forbidden.
13. **Anonymous Proxies:** The use of anonymous proxy scripts on Shahbandr servers is not allowed due to resource abuse.
14. **Child Pornography:** The storage or transmission of child pornography is illegal and will be reported to law enforcement.
15. **Other Illegal Activities:** Shahbandr prohibits any activities deemed illegal, such as fraudulent credit card use or Ponzi schemes. The company fully cooperates with law enforcement regarding such activities.
16. **Backup Storage:** Shahbandr provides e-commerce hosting services, not data storage. Using the account for online file storage or archiving is prohibited and will result in service termination without notice.
17. **Other Activities:** Any activity that, in Shahbandr’s sole discretion, disrupts, interferes with, or harms services, business, or customer relationships is prohibited. This includes offering products designed to violate these terms. Failure to cooperate with Shahbandr in correcting or preventing violations by clients or their associates is also considered a violation.
18. **Copyright Violation Information:** Shahbandr follows the Digital Millennium Copyright Act (DMCA) and will terminate hosting of websites that infringe on third-party copyrights. If a copyright owner believes their rights are being violated on a Shahbandr-hosted website, they may request the removal of the infringing content by providing all necessary information.
– A signature of a person authorized to act on behalf of the owner of the exclusive right allegedly infringed. The work claimed to be copyrighted must be identified, or in the case of multiple copyrighted works allegedly infringed, a representative list of such works.
– Identification of the material claimed to be infringing or subject to infringing activity and that needs to be removed or disabled, with reasonably sufficient information to allow us to locate the material.
– Information reasonably sufficient to allow us to contact the person providing the notice, such as an address, phone number, and, if possible, an email address.
– A statement that the person providing the notice has a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
– A statement that the information in the notice is accurate and, under penalty of perjury, that the person providing the notice is authorized to act on behalf of the owner of the exclusive right allegedly infringed.
19. **Backups:** Shahbandr backs up data on its servers every hour for operational efficiency but isn’t obligated to do so for the client. It’s solely the client’s responsibility to back up their files or data. Shahbandr provides tools for data import/export but isn’t liable for any damages resulting from data loss.
20. **Governing Law:** These terms are governed by U.S. law, specifically Delaware. All disputes involving Shahbandr must be brought exclusively in Delaware courts. Clients agree to personal jurisdiction in these courts and cannot sue Shahbandr outside the U.S.
